The Federal Financial Supervisory Authority (BaFin) is the competent authority for crypto asset service providers in Germany, and a provider that offers services to residents of Germany on a commercial basis needs authorisation. BaFin has stated that providers based abroad need authorisation if they actively target persons resident in Germany (as of June 2026).

Bitfinex does not appear on the register of crypto asset service providers authorised under MiCA, whether through BaFin or through the European Securities and Markets Authority register that brings the national authorisations together. Without that authorisation the platform cannot lawfully provide crypto asset services to residents of Germany as of June 2026.
