Quick answer

As of 26 June 2026, LBank is not authorised under the European Union Markets in Crypto Assets (MiCA) framework and does not appear on the European Securities and Markets Authority register of authorised crypto asset service providers. In Spain the national competent authority is the Comision Nacional del Mercado de Valores (CNMV), and from 1 July 2026 a platform must hold a MiCA authorisation that can be passported into Spain to serve residents. Treat LBank as not available to residents of Spain through a MiCA authorised route and verify the current position before acting.

Availability

Availability for Spain residents

Across the European Union, crypto platforms are now expected to operate under the Markets in Crypto Assets framework, Regulation (EU) 2023/1114, either through a national authorisation or by passporting an authorisation held in another member state. In Spain the national competent authority is the Comision Nacional del Mercado de Valores, working alongside the Banco de Espana, and the European Securities and Markets Authority maintains the union wide register of authorised providers.

As of 26 June 2026, LBank does not appear on the European Securities and Markets Authority register of authorised crypto asset service providers, and it was not previously listed on the Banco de Espana register of virtual asset providers for anti money laundering purposes. The transitional arrangements that allowed some providers to continue under prior national rules are ending, and from 1 July 2026 a full MiCA authorisation is required to serve Spanish residents.

Because LBank holds no MiCA authorisation that can be passported into Spain, the authorised route is treated here as not available, and the position should be confirmed directly with the Comision Nacional del Mercado de Valores.

How it works

Access, KYC, and products

LBank is a global crypto exchange that offers spot and derivatives trading. It is a custodial platform, which means it holds the assets in an account on the user behalf rather than giving the user the private keys, and it requires identity verification, known as know your customer, before trading.

Under MiCA the relevant question for a Spanish resident is authorisation. A provider that serves Spain is expected to hold a MiCA authorisation, safeguard client assets, and meet governance and disclosure standards supervised by the Comision Nacional del Mercado de Valores. Without that authorisation, a platform should not be marketing services to Spanish residents, so confirm the regulatory position rather than the day to day mechanics.

Tax

How crypto is taxed in Spain

Spain taxes crypto for individuals, with the Agencia Tributaria as the tax authority. Gains on disposals are generally taxed as savings income under the personal income tax, and holders may also have reporting duties for foreign held assets and, depending on circumstances, wealth tax considerations.

Rules and thresholds change and depend on personal circumstances, so confirm the current treatment with the Agencia Tributaria or a qualified adviser. See the Spain crypto tax page for a fuller explanation. This is general information, not tax advice (as of 26 June 2026).

Sourcing

Regulator and sources

The Spain national competent authority for crypto under MiCA is the Comision Nacional del Mercado de Valores, working with the Banco de Espana, and the tax authority is the Agencia Tributaria. The position below is stated as of 26 June 2026 and should be confirmed on the primary sources.
