A Markets in Crypto Assets authorisation can be passported across the European Economic Area. However, the Austrian FMA, in an administrative decision dated 18 February 2026, prohibited KuCoin EU Exchange GmbH from commencing business operations because not all supervisory conditions were met, in particular governance requirements and the filling of senior key functions. A separate prohibition on conducting new business, ordered on 19 February 2026, was lifted on 18 May 2026, but the prohibition on commencing operations remained in place as of the FMA notice dated 18 May 2026.
In Sweden the competent authority for crypto asset service providers under the Markets in Crypto Assets framework is the Finansinspektionen.
