The rules in detail

There is no ban on NFTs in Portugal, and individuals can legally mint, buy, and sell them. The starting point for regulation is MiCA. As of June 2026, Article 2(3) of MiCA states that the regulation does not apply to crypto assets that are unique and not fungible with other crypto assets, which carves out genuinely one of a kind NFTs, such as a single digital artwork tied to a unique asset.

The exclusion is narrower than it first appears. As of June 2026, official guidance treats fractional parts of a unique NFT as not unique, so a fractionalised NFT is not excluded. Issuing NFTs in a large series or collection is treated as an indicator of fungibility, which can pull a collection into scope, and simply attaching a unique identifier to a token is not enough on its own to make it unique. National competent authorities apply a substance over form approach, deciding on the qualification of an NFT based on its features and its actual use. The practical result is that a true one off collectible is usually outside MiCA, while a mass minted profile picture collection or an NFT that functions like a financial instrument can be regulated, either under MiCA or under existing securities law supervised by the CMVM.

What this means for users and creators

For a collector, buying and selling unique NFTs is legal and generally outside the crypto asset service rules, but the marketplace you use and the payment token can still bring anti money laundering checks. For a creator or a project issuing a large collection, the classification matters, because a collection judged to be fungible or to resemble a security can trigger authorisation and disclosure duties. Where the position is uncertain, this is an area to confirm with a Portuguese legal professional and the CMVM.
