The rules in detail

There is no law in Portugal that bans owning a crypto wallet or holding your own keys. As of June 2026 an individual can legally use a software wallet, a hardware device, or a custodial account, and self custody is not restricted. The regulatory line falls on who controls the assets. When you hold your own private keys, no provider is involved and no authorisation question arises for you. When a business holds or administers crypto on your behalf, that custody and administration of crypto assets is a regulated crypto asset service under MiCA, implemented in Portugal by Law No. 69/2025 of 22 December.

The Banco de Portugal acts as the prudential and authorising supervisor of crypto asset service providers, including custodians, and the Comissao do Mercado de Valores Mobiliarios, the CMVM, supervises market conduct. As of June 2026 a firm offering custodial wallets to Portuguese residents must be authorised as a crypto asset service provider, and authorisation brings obligations on safekeeping, segregation of client assets, and governance. These rules protect customers of custodians. They do not require an individual who self custodies to register anything.

Self custody and what it means for you

With self custody you carry the practical risk yourself. There is usually no provider to restore access, so losing your keys or recovery phrase can mean losing the crypto permanently, and there is no regulated intermediary to turn to if something goes wrong. A custodial wallet shifts that operational risk to an authorised firm, but it also means you rely on that firm and its controls. This page describes how the two models differ in law and in practice. Holding crypto in a wallet does not by itself create a tax event in Portugal. Tax arises on disposal. As of June 2026 a disposal of crypto held for less than 365 days is taxed at a flat 28 percent, while a gain on crypto held for 365 days or more is generally exempt from personal income tax, except for tokens classed as securities, administered by the Autoridade Tributaria e Aduaneira. Whether the crypto sits on an exchange or in a wallet you control does not change the disposal rules, so keep euro records of acquisition dates and values.
