Buying and holding Ethereum (ETH) is legal in Spain as of June 2026. Ethereum is treated as a crypto asset rather than legal tender, and there is no coin specific restriction on it. Platforms that serve Spanish residents do so under the EU Markets in Crypto Assets Regulation (MiCA), with conduct supervised by the Comision Nacional del Mercado de Valores (CNMV) and anti money laundering matters historically registered with the Banco de Espana.

On licensing, Spain ran a national transitional window that allowed firms that had operated under the earlier Banco de Espana register to continue while their MiCA applications were processed. That window runs to 30 June 2026, so from 1 July 2026 a platform must hold a full CNMV authorisation, or be passported from another member state, to serve Spanish residents. Because authorisations were still being processed through the first half of 2026, confirm a platform's current status in the CNMV or ESMA register before you sign up. Tax arises when you dispose of it, by selling for euro or swapping for another crypto asset, and the Agencia Tributaria (AEAT) taxes the resulting gain in the savings base at progressive rates that for 2026 run from 19% up to 28% depending on the amount. The AEAT applies the first in, first out method, known as FIFO, and treats a crypto to crypto swap as a taxable disposal even though no euro changes hands. Holdings on foreign platforms may also need to be declared on form Modelo 721. Rates, thresholds and deadlines can change each year, so verify your position with the Agencia Tributaria before you file.
